Service Contract Terms
These terms describe the general framework applicable to the professional services offered by Nicolás Carlos Alejandro Torres Barbano through torresnicolas.com or communications derived from the site.

Services may include, according to each proposal:
- Design, development, maintenance, and updating of websites or digital systems.
- Process automation, integration of tools, and internal systems.

- Technical auditing, digital strategy, diagnosis, and support.
- Development, support, or improvement of web projects, e-commerce, or related systems.
The specific conditions of each service will be defined in the proposal, budget, contract, written acceptance, specific conditions, or applicable invoice.
Contracting Process
The usual process is:
- The user contacts via form, email, assistant, or direct channel.
- The request is analyzed, and if necessary, additional information is requested.
- The holder may prepare a proposal, budget, or scope of work.
- The contracting is only formalized when there is express acceptance of the agreed conditions.
- The provision, invoicing, deadlines, price, and payment method will be governed by the specific documentation accepted by the parties.
Payments and Invoicing
The website does not process online payments, does not integrate a payment gateway, and does not request card details.
Payments, when applicable, will be made outside of the website by means agreed upon by the parties. The invoice will be issued in accordance with the applicable tax regulations in Portugal and the information provided by the client for the professional relationship.
Professional Clients and Consumers
The activity is primarily aimed at companies, professionals, agencies, and organizations. If exceptionally a user acts as a consumer, the mandatory consumer protection regulations that apply will be enforced.
Cancellations, Pauses, and Scope Changes
The conditions for cancellations, pauses, modifications of scope, deliverables, revisions, deadlines, and responsibilities will be established in the corresponding proposal or contract.
If there is no specific condition agreed upon, the parties must act in good faith and document in writing any relevant changes before executing them.

Intellectual Property

Limitation of Liability
Services are provided with professional diligence, but commercial, technical, SEO, conversion, billing, or performance results that depend on third parties, the market, client decisions, or factors outside the holder’s control are not guaranteed.
Except for mandatory legal obligations or specific agreements, the holder will not be liable for indirect damages, lost profits, lost opportunities, or unmet results.
Data Protection
Personal data processed during consultations, proposals, service provision, or invoicing will be managed in accordance with the Privacy Policy.
Applicable Law and Jurisdiction
These terms are governed by Portuguese law, without prejudice to applicable mandatory regulations. For B2B relationships, the parties will preferably submit to the competent Portuguese courts, unless a proposal or contract establishes another valid rule.
When the client is a consumer, the applicable jurisdiction will be that which corresponds according to the applicable consumer regulations.
